Terms of Service

By creating an account, accessing, or using the Arthamon Capital Market Terminal (the "Service"), you agree to be bound by these Terms of Service, our Privacy Policy, Cookie Policy, and Risk Disclaimer. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into a binding agreement to use the Service.

Arthamon Capital Market Terminal is a market monitoring and information platform. It provides tools to view market data, watchlists, sentiment indicators, news, and research. It is not a broker, investment adviser, financial adviser, trading venue, exchange, custodian, or portfolio manager. The Service does not execute trades or hold customer funds.

The Service is currently in private beta and under active development. It may contain bugs, downtime, stale data, inaccurate data, incomplete features, or technical interruptions. Features may be added, modified, or removed at any time.

You acknowledge that the Service is provided on an "as is" and "as available" basis and that you use it at your own risk.

Nothing on the Service constitutes investment, financial, legal, tax, or other professional advice, an offer or solicitation to buy or sell any security or financial instrument, or a recommendation of any trading strategy.

You are solely responsible for your own investment and trading decisions and should consult a qualified, licensed professional before making any financial decision.

Market data displayed on the Service may be delayed, partial, intermittent, stale, or unavailable depending on the upstream provider, market hours, technical conditions, and other factors outside our control.

No guarantee is made regarding the accuracy, completeness, timeliness, sequencing, or continuous availability of any data displayed on the Service. You are responsible for independently verifying all information before making any decision.

Research notes, summaries, sentiment scores, alerts, headlines, and other editorial or automatically generated content may be incomplete, inaccurate, out of date, or materially wrong. Such content is provided for informational and monitoring purposes only and must not be relied upon as the sole basis for any decision.

You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized access.

Accounts are personal and non-transferable. Sharing accounts or credentials is prohibited.

Paid access is sold as one-time access periods of fixed duration (for example, 1 week, 2 weeks, 1 month, or annual). Prices are displayed at checkout. Payments are processed by third-party payment providers, including Stripe; their terms also apply to the payment transaction.

Access activates upon successful, verified payment and ends at the conclusion of the selected access period. Access is not renewed automatically unless explicitly stated at checkout.

Except where required by applicable law, payments are non-refundable once digital access has been activated or the access period has started. By starting your access period you expressly request immediate performance of the digital service.

Nothing in this policy excludes or limits any statutory consumer rights, including any non-waivable rights of withdrawal, cancellation, or refund under the laws applicable to you.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations;
• Reverse engineer, scrape, mirror, or attempt to extract source code or non-public data;
• Redistribute, resell, sublicense, or expose the Service to third parties;
• Bypass authentication, rate limits, or access controls;
• Interfere with the operation or security of the Service or upstream providers;
• Use the Service to manipulate markets or facilitate prohibited trading activity.

If you submit notes, research, comments, or other content to the Service, you grant Arthamon Capital a non-exclusive, worldwide, royalty-free license to host, store, display, and process that content solely for the purpose of operating and improving the Service. You represent that you have all rights necessary to submit such content.

The Service, including its software, design, branding, copy, and original content, is owned by Arthamon Capital and its licensors and is protected by applicable intellectual property laws. You receive a limited, revocable, non-transferable, non-exclusive right to use the Service for its intended purpose during the term of your access.

The Service relies on and may display data from third-party providers (for example, market data vendors and news sources) and may link to third-party sites. We do not control and are not responsible for the accuracy, availability, or content of such third-party data or sites, and their inclusion does not imply endorsement.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components. Scheduled maintenance, upstream provider outages, connectivity failures, and unforeseen events may degrade or interrupt access. We will make commercially reasonable efforts to minimize disruption.

We may modify, suspend, or discontinue all or part of the Service at any time. We may also update these Terms; material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

We may suspend or terminate your account or access if you breach these Terms, if your use poses a security or legal risk, or if required by law. You may stop using the Service at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnity, and governing law) will survive.

To the maximum extent permitted by applicable law, Arthamon Capital, its affiliates, and its suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, trading or investment losses, business opportunity, or goodwill, arising out of or related to your use of, or inability to use, the Service.

To the maximum extent permitted by applicable law, our aggregate liability for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid to Arthamon Capital for the Service in the three (3) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.

You agree to defend, indemnify, and hold harmless Arthamon Capital and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your breach of these Terms, or your violation of applicable law or the rights of any third party.

These Terms are governed by the laws applicable at Arthamon Capital's place of establishment, without regard to conflict-of-laws principles. Mandatory consumer protections of your country of residence continue to apply where required by law.
